EQUIPMENT RENTAL & RELEASE AGREEMENT

I accept for use, AS IS, the equipment listed on this form, and accept full financial responsibility for the care of the equipment while it is in my possession.
I hereby absolutely and expressly agree to return the leased equipment on the RETURN DATE specified hereof, subject to the daily rental rates for each day of delay in
RETURN hereof. In the event of loss or theft of the leased equipment, I expressly agree to pay Basalt Bike & Ski an amount equal to the full retail value as posted at Basalt Bike & Ski’s place of business of such leased equipment and subject to daily rental rates for each day until paid in full. In the event Basalt Bike & Ski has to resort to civil law suit in order to enforce this article, I agree to pay Basalt Bike & Ski’s costs and Attorney’s fees of such suit.
Unless waived by Basalt Bike & Ski, which waiver shall be evidenced solely by Basalt Bike & Ski’s clear notation hereof, I hereby expressly agree to pay Basalt Bike & Ski in the event some or all of the leased equipment is damaged or destroyed, the full retail value, as posted by Basalt Bike & Ski’s place of business of such leased equipment and subject to daily rental rates for each day until paid in full. I understand that the damage waiver does not include loss of theft, or intentional misuse or destruction of equipment.
I understand that binding and pedal systems cannot guarantee the user’s safety. In downhill skiing and bicycling, bindings and pedals will not release at all times or under all circumstances where release may might prevent injury or death, nor is it possible to predict every situation in which it will release. In snowboarding, cross- county skiing, ski boarding, snowshoeing and other sports utilizing equipment with non-release bindings, the binding systems will NOT ordinarily release during use; these bindings are NOT designed to release as a result of forces generated during ordinary operation.
I understand that the sports of bicycling, skiing, snowboarding snowshoeing, and other sports (collectively “RECREATIONAL SPORTS” involve inherent and other risks of INJURY and DEATH). I voluntary agree to expressly assume all risks of injury or death that may result from these RECREATIONAL SPORTS, or that relate in any way to the use of this equipment .
I understand that a helmet designed for RECREATIONAL SPORTS use will help reduce the risk of some types of injuries to the user at slower speeds. I recognize that serious INJURY or DEATH can result from both low and high energy impacts, even when a helmet is worn.
I AGREE TO HOLD HARMLESS Basalt Bike & Ski, its Owners, employees, affiliates, agents, officers, directors, and the equipment manufacturers and distributors and their successors in interest (“collectively PROVIDERS”) from all liability from injury, death, property loss, and damage which results from the equipment use and participation in the RECREATIONAL SPORTS for which the equipment is provided, or which is in any way related to the use of this equipment including liability which results in the NEGLIGENCE of PROVIDERS, or any other person or cause.
I further agree to defend and indemnify Providers for any loss or damage, including and that result from claims or lawsuits for personal injury, death, and property loss and damage related in any way to the use of this equipment.
This agreement is governed by the applicable laws of this state. If any provision of this agreement is determined to be unenforceable, all other provisions shall be given full force and effect.
Acknowledgement of Personal Information & Equipment and Instructions
I have accurately represented the listed information on this form and it is true and correct. I have made no misrepresentations to Basalt Bike & Ski in regard to my height, weight, age, cycling ability, skier type, or snowboard stance. I will not use any of the equipment to be provided to me during this transaction until I have received instructions on its use and I fully understand its use and function. I verify that the visual indicator settings recorded on this form for downhill ski equipment agree with the number appearing in the visual indicators window of the equipment listed on this form.
